IEP or 504?

Presented by: Alefia Mithaiwala

Do you often wonder whether it is time to make a referral for assessment under IDEA? Should Section 504 be viewed as a necessary step, prior to making a referral for IDEA assessment? Or conversely, is a Section 504 Plan a necessary “step down” when a student is no longer eligible under the IDEA? How do these laws differ, and how are they similar, with respect to serving students with disabilities? Join expert attorney, Alefia Mithaiwala, as she discusses child find obligations under both the IDEA and Section 504, and compares and contrasts eligibility determinations and the provision of FAPE under both laws. Attendees will gain an understanding of the criteria for eligibility under each law, which in turn, will assist your teams in making those critical decisions of which path to proceed under, when a student is struggling in school.
